This policy governs your use of the Fueled Collective website, fueledcollective.com, and all associated sites linked to fueledcollective.com, (collectively, the “Website”), the Fueled Collective Mobile Application (the “App”), and the proprietary Fueled Collective software program “Octane” (the Website, App, and Octane referred to collectively as the “Fueled Platforms”). The Fueled Platforms are designed to allow users to make membership purchases, register for conference rooms, pay for services, buy merchandise, and communicate with Fueled Collective. Fueled Collective knows that you care about how your information is used and shared, and we appreciate your trust that we will do so carefully and sensibly. Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used at this site. Please read this privacy policy before using the site or submitting any personal information.

Acceptance of terms

By visiting the Fueled Platforms or Services (defined below), or communicating with Fueled Collective via email, you are accepting the terms of and the practices described in this “Privacy Policy” and the Fueled Collective “Terms of Service”. You also consent to receive communications from Fueled Collective electronically. Fueled Collective will communicate with you by email or by posting notifications on the Website and/or the App. You understand and agree that all agreements, notices, disclosures, and other communications that Fueled Collective provides electronically satisfy any legal requirement that such communications be in writing. If you do not agree to this, please refrain from using the Fueled Platforms, or Services. Your continued use of the Fueled Platforms, or Services following the posting of changes to these terms will indicate your acceptance of those changes. WE MAY ALSO COMMUNICATE WITH YOU BY SMS, MMS, TEXT MESSAGE OR OTHER ELECTRONIC MEANS TO YOUR MOBILE DEVICE. CONSENT TO THE FUELED COLLECTIVE TERMS OF SERVICE AND THIS PRIVACY POLICY IS NOT A CONDITION OF PURCHASE.

By visiting a Fueled Collective workspace location, you hereby grant us an absolute and irrevocable right, license and unrestricted permission to use photographs or video taken of your image and likeness, and to use, re-use, publish and re-publish the same in whole or in part, individually or in conjunction with other photographs and any printed or video matter, in any and all media now or hereafter known, and for any purpose whatsoever allowed by law for illustration, promotion, art, editorial, advertising and trade, or any other purpose whatsoever without restriction as to alteration.

General statement on privacy, personal data & communications

We will always respect your privacy. Sometimes, we may ask you for personal information like name, phone number, address, email address, etc. so that we can better serve you and offer you discounts and promotions. If you use the Fueled Platforms, you are responsible for maintaining the confidentiality of your account, password, and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and password.

The information we collect

We receive, collect and store any information you enter on the Fueled Platforms, or give us in any other way such as names, postal addresses, email addresses, credit card information etc., when voluntarily submitted by users of (and visitors to) the Fueled Platforms. The information you provide is used to fulfill your specific request, to improve the experience on the Fueled Collective site, to ensure a successful experience at a Fueled Collective, and to adhere to the Terms and Conditions you accept when you make a purchase on the Fueled Platforms. From time-to-time on the Fueled Platforms, you may be able to order services, products, enter contests, vote in polls or otherwise express an opinion or subscribe to one of our services. No one under age 13 may provide any personal information to or on our website. In the event that we learn that any personal information has been submitted to the website from a child under age 13, we will delete that information as quickly as reasonably possible. Our commitment to security

Fueled Collective provides wireless Internet access to its members and their guests via an unsecured wireless network (“Services”). It is strongly recommended that you do not use our network to transmit personal, financial, or legal data. Fueled Collective is not responsible for malicious theft or interception of data transmitted over our wireless network. Your access to the Service is completely at the discretion of Fueled Collective, and your access to the Service may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of this Privacy Policy or these terms, actions that may lead to liability for Fueled Collective, disruption of access to other users or networks, or violation of applicable laws or regulations. Fueled Collective may revise the Privacy Policy at any time. You may use the Service only if you agree to the Privacy Policy and following terms of service each time you access the Service.

Fueled Collective assumes no responsibility for the safety of equipment or for harm done to laptop/PDA configurations, security, or data files resulting from connection to Fueled Collective wireless service. This is an open wireless network. No network communication is 100% secure. Virus and security protection is your responsibility. Fueled Collective staff may not provide technical assistance and no guarantee can be provided that you will be able to make a wireless connection.

All users of Fueled Collective network must abide by the Internet Acceptable Use Policy:

In offering Internet access, Fueled Collective cannot guarantee that information found through the Internet is accurate, authoritative, or factual. We cannot be held accountable for its content. Supervision or restriction of a minor’s (under age of 18) access to the Internet is the responsibility of the parent or legal guardian. The Internet must be used for legal purposes only. Your use of this Service shall not violate any applicable law or regulation or the rights of Fueled Collective, or any third party.

Unacceptable purposes may include but are not limited to the following:

Destruction or damage to the equipment, software, or data belonging to Fueled Collective. Unauthorized downloading or copying of copyright protected material. Violation of computer security. Violation of software license agreements. Viewing of obscene, pornographic, or otherwise inappropriate material. Spamming and invasion of privacy of others, violating intellectual property law, transmitting obscene or indecent speech or materials, transmitting defamatory or abusive language, hacking or distribution of internet viruses, worms, trojan horses, or other destructive activities.

Misuse or abuse of Internet access may result in suspension of Internet and or the Services, as well as termination of your membership with Fueled Collective.

How to stop getting future emails from us

If you no longer want to receive emails, please let us know. You can opt out/unsubscribe from receiving information at any time using the “unsubscribe from this list” or “update subscription preferences” link provided at the bottom of any email you receive from us, or by emailing info@fueledcollective.com.

Warranty disclaimer and limitation of liability

In no event will Fueled Collective be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Fueled Platforms, the Services, or on any other linked/third-party website, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if Fueled Collective expressly advised of the possibility of such damage. All information is provided by Fueled Collective on an “as is” basis only. Fueled Collective provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.

You acknowledge (i) that the Service may be interrupted or encounter errors; (ii) that viruses or other harmful applications may be available through the Service; (iii) that Fueled Collective does not guarantee the security of the Service and that unauthorized third parties may access your computer or files or otherwise monitor your connection.

THE FUELED PLATFORMS, SERVICES AND ANY PRODUCTS OR SERVICES PROVIDED ON OR IN CONNECTION THEREWITH ARE PROVIDED ON AN AS IS, AS AVAILABLE BASIS WITHOUT WARRANTIES OF ANY KIND. The Fueled Platforms, Services, and your use hereof, is governed by the laws of the State of Ohio, without regard to Ohio’s choice of law provisions. Any claim arising out of your use of the Fueled Platforms, or Services must be brought in Ohio.
